Piracy is a practice of organized looting or maritime banditry, probably as old as navigation itself. Is that a private boat or a state mutinous attacks another in international waters or in areas not under the jurisdiction of any State, in order to steal their cargo, demanding ransom for the passengers, turning them into slaves and often seize the ship itself. Its definition under international law can be found in Article 101 of the United Nations Convention on the Law of sea.

Along with the activity of the pirates preying on their own for their profit motive, include privateers, private entrepreneurs seamen employed by the state of marque to attack and loot the ships of an enemy country. The distinction between pirate and privateer is necessarily partial, because privateers as Francis Drake or the French fleet at the Battle of Terceira Island pirates were considered vulgar by the Spanish authorities, since there was no war declared their nations. However, the availability of a letter of marque did offer certain guarantees to be treated as another army soldier and not as a mere bandit, thief and murderer; at the same time it entailed certain obligations.
